Land Dealing

Ministerial consent to a land dealing is subject to Land Transfer Act Cap. 137

Procedural Requirements

Applications for consent by the Minister responsible for land matters to a Dealing under the Land Sales Act require the following:

  • Applications must be submitted in quadruplicate providing, in full, all the required information
  • Certificate of Title copy (showing the most recent endorsements at the back thereof) must be attached. This is required to verify present ownership. The vendor(s) or their legal representatives should agree to the sale
  • Police clearance from country of normal residence of intending purchaser(s) should be submitted if the Land (developed or undeveloped) is over one hectare (2 ½ acres)
  • Police clearance is not required where the intending purchaser already has a permit to enter, reside and work in Fiji
  • Copy of the FTIB approval where the dealing involves the purchase of an existing business or the setting up of a new business
  • The offer for sale of freehold of over 10 hectares (ie approximately 25 acres) should first be advertised locally before an application for consent is considered by the Minister . Such advertisement should appear twice in the English daily newspapers and twice over the Radio Fiji in the Fijian Language
  • The offer for sale of freehold land less that 10 hectares (ie less than approximately 25 acres) does not have to be advertised locally as a condition before an application for consent to sell is considered by the Minister
  • Provided all documents are available when lodging applications, we normally try to finalise them within two weeks from the date of receipt and subject of course to the availability of the Minister, and the number of applications attended to.

Application Fees

The prescribed fees came into effect on 1 st January 1999.

  • Application and Consent Fees $112.50 - FJD (per application)
  • Variation Fees (eg. Consent) $33.75 - FJD (per variation)
  • Appeal Fees $112.50 - FJD
